These Terms & Conditions (“Terms”) govern the use of the website, services, travel planning, travel booking, agent enrollment, and business operations provided by LIVIN LA MAGIC LLC, doing business as LIVIN LA MAGIC TRAVEL and LLM TRAVEL (“LIVIN LA MAGIC,” “we,” “us,” “our”).
By accessing our website, using our services, or booking any travel through us or our affiliated independent contractors, you agree to be bound by these Terms.
If you do not agree with these Terms, you must discontinue use of our website and services immediately.
1. DEFINITIONS
“Client,” “Traveler,” “Guest” — any individual or entity purchasing or inquiring about travel services through us.
“Advisor,” “Agent,” “Independent Contractor,” “IC” — individuals operating under our host agency for commissions.
“Supplier,” “Vendor,” “Provider,” “Third-Party Provider” — hotels, airlines, cruise lines, tour operators, insurance companies, theme parks, transportation companies, booking platforms, and travel service suppliers.
“Website” — www.livinlamagic.com, www.tern.travel and any affiliated digital platforms.
“Booking” — any reservation, payment, or travel arrangement made through us.
2. USE OF WEBSITE
By using our website, you agree:
To provide accurate, complete, and real and your genuine information
To use the website only for lawful travel-related purposes
Not to disrupt, misuse, or attempt to gain unauthorized access to our systems
That all content, trademarks, designs, and intellectual property belong to LIVIN LA MAGIC and may not be copied, reproduced, or repurposed without written consent
3. ROLE OF LIVIN LA MAGIC
LIVIN LA MAGIC acts as an intermediary between clients/travelers, IC, travel agents/advisors and travel suppliers.
We arrange travel services on your behalf but do not own, operate, or control airlines, cruise lines, hotels, theme parks, tour operators, or transportation companies.
Therefore:
All bookings are subject to each supplier’s terms, conditions, and policies
LIVIN LA MAGIC is not responsible for supplier acts, omissions, errors, delays, service failures, schedule changes, government actions, or force majeure events
4. BOOKING CONDITIONS
4.1. Accuracy of Information
Clients are responsible for providing accurate names, dates, identification, payment details, and travel preferences.
Names must match the traveler’s passport/government ID exactly. LIVIN LA MAGIC is not responsible for fees resulting from incorrect information.
4.2. Payment Terms
Payment schedules vary by supplier
Deposits may be non-refundable
Some bookings require payment in full at the time of reservation
Payment processing may be handled by third-party providers
Failure to pay by deadlines may result in cancellation without refund.
4.3. Travel Documents
The traveler is solely responsible for securing:
Passports
Visas
Entry permits
Vaccinations or health certifications
Compliance with destination requirements
LIVIN LA MAGIC provides guidance but cannot guarantee document approval.
5. CHANGES, CANCELLATIONS & REFUNDS
5.1. Supplier Policies
All changes, cancellations, credits, and refunds are governed exclusively by the travel supplier’s policies.
Suppliers may impose:
Penalties
Fees
Non-refundable deposits
No-refund restrictions
Date-change fees
and others implications
LIVIN LA MAGIC does not control these policies now.
5.2. Agency Fees
LIVIN LA MAGIC may charge:
Planning fees
Change or cancellation service fees
Research fees
Itinerary development fees
Agency fees are non-refundable, even if the supplier issues no refund.
5.3. Force Majeure
We are not liable for disruptions due to events outside our control, including but not limited to:
Natural disasters
War or political unrest
Pandemics or health emergencies
Supplier insolvency
Transportation delays or cancellations
6. TRAVEL RISKS & RESPONSIBILITIES
Travel inherently involves risk. By booking with LIVIN LA MAGIC, you acknowledge:
Conditions, safety standards, and rules vary by country and supplier
Activities may involve dangers (water activities, adventure tours, wildlife, transportation, etc.)
We are not liable for injuries, loss of property, accidents, illness, or death
If you are a USA legal resident with a valid passport or Real ID. We highly recommend purchasing travel insurance.
7. TRAVEL INSURANCE
We strongly encourage all travelers to purchase travel insurance, including:
Trip cancellation
Delays
Medical emergencies
Evacuation
Lost luggage
Declining insurance is at your own risk.
8. THIRD-PARTY SUPPLIERS
When booking travel through LIVIN LA MAGIC, you agree:
We may share your information with suppliers to fulfill services
Suppliers may contact you directly regarding itinerary or policy changes
Supplier terms overrule our terms when related to their services
We are not responsible for:
Pricing errors
Overbooked flights, rooms, cruise cabins, tours, special events, theme parks tickets
Supplier cancellations
Itinerary changes
Technology outages from third-party systems
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, LIVIN LA MAGIC is not liable for:
Personal injury, property damage, or financial loss
Mistakes, omissions, or negligence by suppliers/providers
Acts of God, force majeure events, or political instability
Traveler failure to comply with rules, documents, or deadlines
Errors in traveler-provided information
Services not directly provided by LIVIN LA MAGIC
Our maximum liability shall never exceed the total amount paid to us for service fees (not including supplier payments).
10. INDEPENDENT CONTRACTORS (ADVISORS)
Independent contractors affiliated with LIVIN LA MAGIC agree to:
Abide by all legal, ethical, and brand guidelines by our consortia and us
Maintain confidentiality of client data
Operate using secure technology and CRM systems
Use the only approved vendor channels for bookings
Provide truthful and professional conduct any time
LIVIN LA MAGIC is not responsible for:
Advisor misrepresentation or negligence
Unauthorized travel advice given by an IC
Unauthorized communication or payments made outside approved channels
Clients booking through an IC acknowledge that the advisor is an independent business operator, not an employee of LIVIN LA MAGIC.
11. DATA PRIVACY
Use of our services is also governed by our Privacy Policy, which explains:
How we collect and use data
How we share data with suppliers
Your rights under privacy laws
Agent-specific confidentiality rules
California residents also have rights under the CCPA/CPRA.
12. WEBSITE CONTENT AND INTELLECTUAL PROPERTY
All content on our website—including text, images, logos, branding, designs, guides, PDFs, and digital resources—is the property of LIVIN LA MAGIC and protected by copyright laws.
You may not:

Distribute
Reproduce
Modify
Sell
Create derivative works
without written permission.
13. DISPUTE RESOLUTION & GOVERNING LAW
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute shall be resolved exclusively through:
Binding arbitration in the State of Florida, or
A court of competent jurisdiction located in Osceola, Florida
You waive the right to participate in class-action litigation.
14. SEVERABILITY
If any part of these Terms is determined unenforceable, the remainder will continue in full effect.
15. MODIFICATIONS TO TERMS
We may revise these Terms at any time. Revised versions will be posted on our website with an updated effective date.
Continued use of our services constitutes acceptance of the updated Terms.
